Welcome to SpotsPlace Gaming. These Terms of Service govern your use of our consulting services for Tobique First Nation gaming license applications and related compliance support.

1. Service Scope

SpotsPlace Gaming provides consultation and application support services for operators seeking gaming licenses through Tobique First Nation jurisdiction. We act as consultants - not legal representatives - connecting you with the licensing authority.

Our services include:

  • Initial eligibility assessment and jurisdiction guidance
  • Application document preparation and review
  • Communication facilitation with Tobique Gaming Commission
  • Compliance framework setup assistance
  • Ongoing regulatory advisory (separate engagement)

2. Client Responsibilities

You agree to provide accurate, complete information throughout the application process. This includes financial documentation, ownership structure details, and technical specifications for your gaming operation.

Final licensing decisions rest solely with Tobique First Nation Gaming Commission. We cannot guarantee approval - though our 95%+ success rate speaks for itself.

3. Fees and Payment

Consultation fees are outlined in your service agreement. License application fees paid directly to Tobique jurisdiction are separate and non-refundable, regardless of application outcome.

Payment terms: 50% upfront, 50% upon application submission. Refunds apply only if we determine your operation is ineligible before starting work.

4. Confidentiality

We protect your business information. Period. Client data is shared only with Tobique Gaming Commission as required for your application - never with third parties without explicit consent.

We maintain secure document handling practices compliant with Canadian privacy standards.

5. Timeline Estimates

Our advertised 30-45 day licensing timeline reflects typical processing for complete applications. Delays can occur if:

  • You submit incomplete documentation
  • Additional due diligence is required by the Commission
  • Your technical setup needs modifications
  • Seasonal processing variations at jurisdiction level

We'll keep you informed throughout, but can't control external factors.

6. Limitation of Liability

SpotsPlace Gaming provides consulting services in good faith based on current regulatory requirements. We're not liable for changes in Tobique jurisdiction policies, your operational decisions post-licensing, or third-party service provider issues.

Our maximum liability is limited to fees paid for our services.

7. Termination

Either party can terminate the engagement with 14 days written notice. You remain responsible for fees covering work completed to date.

If Tobique Gaming Commission denies your application for reasons outside our control, you may restart the process at a reduced rate (minus already-paid jurisdiction fees).

8. Governing Law

These terms are governed by the laws of New Brunswick, Canada. Disputes will be resolved through binding arbitration before litigation.

9. Changes to Terms

We may update these terms occasionally. Existing clients will be notified 30 days before changes take effect. Continued use of our services after updates constitutes acceptance.
